/5 And that's just the first page. If I analyzed this for a client I'd tell them that this lawyer doesn't know defamation law and is in a panic. I'm not anybody's lawyer here but this letter's bluster and lack of professionalism scream "the dude did it" to me.

I thought all the guilty California politicians hired Charles Harder for their defamation work.

I’m not a lawyer but can I take a stab at the appropriate response here?

“We look forward to a thorough and robust discovery process.”

Also it’s not 24 days until June 2.

Ballots go out May 4th and early voting starts May 23rd.

It's the citing of case law to a non-lawyer that made me raise my eyebrow.

Why? Maybe Stalwell's attorney didn't yet know who the person's attorney is. We (lawyers) understand that non-attorneys will provide a cease & desist letter, or other legal letter, to their attorney. We don't expect a layperson to know the body of law behind our citations.

LoL. Of course the case they cited isn't about this. The case they cited was primarily about whether the person allegedly defamed was a "public official"

i met and talked with Swal at a voting tech convention maybe 10 years ago. he's charismatic and well spoken in person, comfortable in large & small settings - all generally applicable characteristics of politicians, particularly in his district. i didn't get a creepy feel from him, but i'm male&tall

I have had a Swalwell-adjacent interaction twelve years ago and I think you should take a fucking seat on this one, my dude.

i'd love to give him the benefit of simply choosing the wrong atty/advisor in this, but all your notes are entirely on point. not looking good here.

i'm sad. he's generally been progressive and fair, in politics. up till now, i hadn't heard anything about him treating his underlings poorly.

"The timing demonstrates that the claim is false" is also a component of the throwing-spaghetti-at-the-wall approach on display. It's a non sequitur.

/6 I thought Platner stans were fucking creepy until I met Swalwell stans, one of whom just told me women should say "no" more forcefully

Walking into a hornets’ nest here … from distance Platner appears more likely than Mills to win seat Dems MUST win, he’s younger, he’s not privileged elite. Those weigh heavily in his favor. Are they outweighed by evidence of his character? I don’t know enough but understand why progressives split.

For real? "But how can we know that no means no unless she punches me in the dick when she says it?"

/7 For those who asked, the letter being sent by text message probably signifies they don't have a current address or email for the woman, but have a cell phone number, and are desperate to threaten immediately.

That’s a typical response in my experience. Many men have childish and immature views on sexual assault. It’s a chosen state of ignorance.

I'm wondering how many of those Swalwell stans here are anything other than MAGA disinformation trolls cosplaying as Dems.

Daw a study that showed most of yhe K-hive trolls were foreign. I wouldn't put much stock into any account that isn't personally identifiable and yes I am aware of the irony.

Planter has a bunch of red flags and indications he does not take sexual seriously enough, there has been so far zero indications of actual inappropriate behavior toward women from himself. (so far and would not really be surprised if something surfaces) Swalwell has had an edge of a creep forever.

Apparently one or more of the accusers were incapacitated at the time of the "encounter." How to say no then? Post-It notes in their undies, just in case?

It’s always a woman’s job to stop a guy from sexually assaulting her and never a guy’s responsibility to not sexually assault

Yiiiiiiiikes. The only Swalwell stan I know is gay, and it’s more of a “would” situation than stan situation
