The Board of Immigration Appeals has issued a final administrative removal order against Mahmoud Khalil. His lawyers, who anticipated this, said it didn’t impact the status quo, they’ll appeal to the 5th Circuit, & that he cannot be detained while his habeas case is pending.

ICE has been citing a May 2025 memo to justify arrests in immigration courts. An agency lawyer told prosecutors yesterday that it doesn’t include such authorization.

This means ICE has not provided any legal justification for the mass arrests at EOIR courts in NY or other states.
