It is a legal minefield: the 1st Amendment protects Freedom of Expression, Freedom of Assembly & Freedom of Speech. Ostensibly, a federal law could be created in which the Confederate flag used in acts of insurrection (e.g. 6/1/ 2021) incriminates via its associations with Fascism.
