Bracketing that, why is this not a statutory issue? How is it not the case that police's extraordinary powers are in exchange for duties they must fulfil?

On your second point, I share the puzzlement that statutes in every state should require duties of protection from armed representatives of the state. On your first point, don’t get me started. Yes, the Constitution claims it is supreme law, but it is not only & not mostly that.

It’s primary function is to organize a regime, that is, a particular way of political life. To treat it primarily as law is to get the consequence you highlight.
