Unfortunately, there can be no claim for defamation against the government for a variety of reasons. Number 1 is that it is not possible to defame a dead person. Number 2 is that you can’t sue US Government agencies for defamation.

I dunno, Ben, but a good law review article could: (a) advocate for the standing of the families to bring a claim; and (b) amend the Federal Torts Claim Act to include defamation.

Families can only bring a claim if the fact claims impune their own reputations. To succeed on a defamation claim, the damages element must be satisfied. No action to amend the Federal Tort Claims Act can affect the cases of Good and Petti as that would be an ex post facto law.

If the government is acting illegally, it’s not government official business, and if we ever get out of this nightmare, the new Supreme Court will absolutely ensure that no one is above the law. That’s where we failed 2021-2024.
